1. Acceptance of Terms

By using our website or purchasing products, you agree to be bound by these Terms and Conditions and all applicable laws and regulations of England and Wales.

These terms form a legally binding agreement between you and aurastarmemorials Ltd, a company registered in England and Wales under company number 16129199.

2. Use of Website

You may use our website for legitimate purposes such as browsing, purchasing, and contacting support.

Unauthorised use, including unlawful activity or system interference, is strictly prohibited.

3. User Accounts and Registration

You are responsible for maintaining your account credentials and ensuring all provided information is accurate.

You must notify us immediately of any unauthorised account activity.

4. Products and Pricing

All products are subject to availability. Prices may change without notice.

All prices displayed on our website are in pounds sterling (£) and include VAT at the applicable rate (currently 20% standard rate). There are no hidden charges. The total price you pay, including VAT and any delivery charges, is shown clearly before you complete your order, in compliance with the Digital Markets, Competition and Consumers Act 2024.

We do not guarantee that product descriptions are error-free, though we strive for accuracy.

5. Orders and Payment

Orders may be accepted or rejected at our discretion. Payment must be completed before shipment.

We accept payment by Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay, Klarna, and Clearpay. We use secure, PCI-compliant systems to process all payments.

6. Shipping and Delivery

We ship to addresses within the United Kingdom. Delivery times typically range from 2–4 business days for UK mainland addresses, depending on the method selected. Additional charges or longer delivery times may apply for the Scottish Highlands and Islands, Northern Ireland, Channel Islands, and Isle of Man.

We use trusted UK carriers including Royal Mail, DPD, Evri, Yodel, and DHL.

Risk of loss transfers to you upon delivery.

7. Returns and Refunds

Your statutory rights are protected under UK consumer protection law. You have two distinct return rights:

14-day cooling-off period (Consumer Contracts Regulations 2013): If you change your mind, you may cancel your order within 14 days of receiving the goods and return them for a full refund. You must notify us of your cancellation and return the goods within 14 days of notifying us. You are responsible for the cost of return shipping unless the goods are faulty or misdescribed. Exclusions apply to personalised items, sealed hygiene goods that have been opened, and perishable goods.

30-day right to reject faulty goods (Consumer Rights Act 2015): If goods are faulty, not as described, or not of satisfactory quality, you have the right to reject them and receive a full refund within 30 days of receipt. We will cover the cost of return shipping for faulty or misdescribed goods. After 30 days, you may be entitled to repair, replacement, or a price reduction.

Refunds are processed within 14 days of our receipt of returned goods or proof of return, using the same payment method you used for the original purchase.

8. Limitation of Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

Subject to the above, our liability for any claim arising from your use of our website or purchase of our products is limited to the purchase price of the product. We are not responsible for indirect or consequential damages.

Your statutory rights under the Consumer Rights Act 2015 are not affected by these terms.

9. Privacy and Data Protection

Your personal data is handled in accordance with our Privacy Policy and all applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

You have the right to access, rectify, erase, restrict processing of, object to processing of, and receive a portable copy of your personal data. You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk.

10. Intellectual Property

All website content, including text, images, logos, and design, is owned by aurastarmemorials Ltd and protected by intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.

11. Governing Law and Disputes

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of our website will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have the right to refer a dispute to an alternative dispute resolution provider. We recommend Citizens Advice (citizensadvice.org.uk / 0808 223 1133) or your local Trading Standards office for consumer guidance.

12. Modifications to Terms

We may update these terms at any time. We will notify you of material changes by posting the updated terms on our website with a new "Last updated" date. Continued use of the website after changes are posted constitutes acceptance of the revised terms.

13. Severability and Entire Agreement

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

These terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and aurastarmemorials Ltd.
